Amendments to Michigan’s Bottle Bill effective March 1, 2011 required bottle manufacturers to provide Michigan-specific markings on non-alcoholic bottles and cans meeting certain sales thresholds. The regulations were intended to prevent returning beverage bottles purchased in other states for a higher deposit in Michigan. These regulations effectively require manufacturers to produce Michigan-specific bottles (at a higher cost) for sale within the State. In response the American Beverage Association has filed suit against the State of Michigan to challenge the constitutionality of the new regulations, alleging that they violate federal interstate commerce laws.
